New obligation for real estate professionals at the start of this year!
The Statement of Risks and Pollution (ERP) becomes the Statement of Risks (ER) – new text, new obligations, new sanctions… and new questions. Law No. 2021-1104 of August 22, 2021, concerning the fight against climate change and the strengthening of resilience to its effects (known as the “Climate and Resilience” law), amended Article L. 125-5 of the Environmental Code relating to the obligation for the owner of a property to provide their purchase or tenant with a Statement of Risks and Pollution (formerly “ERNT”, then successively renamed “ERNMT”, then “ESRIS”, then “ERP” and now “ER”). What's changing: The ER adds the risk linked to sea level rise; the obligation to include in "any advertisement, regardless of its medium of dissemination, relating to the sale [or rental] of a property which must be the subject of a Statement of Risks [...] a statement specifying how to access the information mentioned" in the Statement of Risks relating to its asset; and to "provide" the Statement of Risks to the potential buyer(s) or tenant(s) "during the first visit to the building".
